GENERAL CONDITIONS OF SALE
The offer and sale of products made on the site cliziashoes.it are governed by these general conditions of sale. The customer is required, before submitting your purchase order, to carefully read these general conditions of sale. The forwarding of the purchase order implies full knowledge and express acceptance of both the aforementioned general conditions of sale and what is indicated in the Order Form. Once the online purchase procedure has been completed, the Customer is required to print and keep these general conditions of sale and the relative order form, which have already been viewed and accepted.
1. Object
1.1 The purpose of these General Terms and Conditions of Sale is the sale of products carried out online through an e-commerce service on the cliziashoes.it website.
1.2 The products sold on the cliziashoes.it website can be purchased and delivered exclusively in the countries indicated in the Order Form. Any orders for shipments to be made outside these countries will be automatically rejected during the order processing procedure.
2. Subjects
2.1 The products are sold directly by Calzaturificio N.C. di Nicola Conca with legal and administrative headquarters in via barletta s.s.16 km.755+300 in Trani (BT) Italy, tax code and VAT number 04085510727 (hereinafter referred to as the "Seller"). For any request for information, you can contact us by e-mail at the following address: info@nicolaconca.com.
2.2 These General Conditions of Sale govern the offer, transmission and acceptance of purchase orders for products on cliziashoes.it and do not govern, however, the provision of services or sale of products by parties other than the Seller who are present on cliziashoes.it, through links, banners or other hypertext links. Before placing orders and purchasing products and services from parties other than the Seller, we recommend that you check their conditions of sale, because the Seller is not responsible for the provision of services by third parties other than the Seller.
2.3 The products are sold to the Customer identified by the data entered when completing and sending the order form in electronic format with simultaneous acceptance of these General Conditions of Sale.
3. Sale through an electronic commerce service
3.1 In order to conclude the contract for the purchase of one or more Products, you must fill in the electronic order form (hereinafter the Order) and send it to the Seller via the Internet, following the relevant instructions.
3.2 Although the Seller constantly takes measures to ensure that the photographs shown on the Site are faithful reproductions of the original products, including the adoption of every possible technological solution to reduce inaccuracies to a minimum, certain variations are always possible due to the technical characteristics and colour resolution characteristics of the computer you are using. Consequently, the Seller shall not be held liable for any inadequacy of the graphic representations of products shown on the Site when due to the aforementioned technical reasons, since such representations have merely an illustrative function.
3.3 Before concluding the contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale including the Information on the right of withdrawal and the processing of personal data.
3.4 The contract is concluded when the Seller receives your Order Form via the Internet, after checking that the data relating to your order is correct.
3.5 The language available to conclude the contract with the Seller is Italian and the applicable law is Italian law.
3.6 Once the contract is concluded, the Seller will take over your Order for processing.
3.7 Sales transactions are not subject to the obligation to issue an invoice, nor to the obligation to certify by issuing a receipt or fiscal receipt. The User will receive an e-mail confirmation of the order summarizing the same.
4. Evasion of the Order
4.1 By transmitting your Order over the Internet, you unconditionally accept and undertake to observe these General Terms and Conditions of Sale in your relations with the Seller.
4.2 Once the contract is concluded, the Seller will send you an Order Confirmation by e-mail, containing a summary of the information already contained in the Order.
4.3 The Seller may, prior to sending the Order Confirmation, ask you for further information about the Order you have sent over the Internet by e-mail or by telephone.
4.4 If the products presented on the website are no longer available or on sale after the Order has been placed, the Seller will inform you of the unavailability of the ordered Products in a timely manner and in any case within ten (10) working days from the day following the day on which you sent your order to the Seller. In this case, the sum previously committed to the Customer's means of payment shall be released. If, following this communication of temporary unavailability of the Product, the Customer formally communicates his wish to proceed with the purchase of the Product, the Seller may decide to exceptionally manufacture the Product, with a delivery time of not less than 15 days in relation to his formalised wish to the Customer. In this case, however, it will not be possible to proceed with the return.
4.5 Each sale made by the Seller through the online sales service may relate to one or more products.
4.6 The Seller reserves the right to refuse orders from a customer with whom a legal dispute is pending regarding a previous order. The Seller shall make every effort to ensure that the service of the e-shop is not interrupted. Nevertheless, even if the utmost care is taken, downtime cannot be excluded. The vendor reserves the right to change and suspend the service at any time.
5. Selling prices
5.1 Unless otherwise specified in writing, all prices of the Products indicated on the website and in the Order are to be considered VAT included and expressed in Euros. The validity of the prices indicated is always and only that indicated on the website at the time the Order is transmitted through the Internet. The prices of the Products and the shipping and delivery costs may vary without notice.
5.2 All Products are shipped directly from Italy. The prices of the Products and of the shipping and delivery costs indicated on the website and in the Order, unless otherwise specified, are not to be considered inclusive of any costs related to customs duties and relevant taxes if the shipment takes place in non-EU countries or in countries where the applicable regulations provide for import charges.
6. Methods of payment
For the payment of the price of the Products and the related shipping and delivery costs, you can follow one of the methods indicated in the order form on the cliziashoes.it website and which are summarised below.
6.1 Paypal, Bank Transfer, Amazon Pay, Klarna and Credit Cards (Visa, Mastercard, etc.).
6.1.1 If you have a Paypal account, the seller enables you to make payments directly using the email and password you used to register with www.paypal.it.
6.2 At no time during the purchase process is the Seller able to know information relating to your credit card (for example, the credit card number or the date of its expiry), transmitted via a connection protected by encrypted protocol directly to the site of the party handling the electronic payment (banking institution or Paypal). No computer file of the Seller will retain such data.
6.3 Under no circumstances, therefore, may the Seller be held liable for any fraudulent and improper use of credit and prepaid cards by third parties.
7. Shipping
7.1 Each shipment contains the ordered product, the relevant delivery note, any accompanying documentation required depending on the country of shipment and any information and marketing material.
7.2 Product shipment times vary depending on stock availability from 2 to 10 business days. The seller is not responsible for any delivery delays caused by the courier company. During periods of high order volume, it may take up to 14 business days. August is not to be counted as a delay in delivery of orders. Due to courier stoppages during the week of August, shipments will be suspended. Orders arrived (and paid) during this time will be progressively processed based on the date payment is received.
7.3 The delivery of Products purchased through the Seller's website may take place in various ways.
7.4 Delivery to the Customer's home
7.4.1 The purchased products will be delivered by the courier identified by the Seller to the shipping address indicated by the Customer on the Order. In case of non-pickup and customs clearance by the Customer, the Seller reserves the right to charge the return costs with attached charges to the Customer, reversing the amount charged by the appointed courier from the amount that the Seller will reimburse the Customer.
7.4.2 When you receive the package at your home address, we ask you to check the integrity of the packages as they are delivered by the courier. If there are any defects, you must have the courier detect and note them exactly and reject the delivery, or accept the package with "reserve rights". Failure to do so will result in the loss of your rights in this respect.
7.4.3 The couriers used for shipments are UPS, GLS and DHL.
8. Return/Exchange
8.1.1 All products can be returned for a refund or for a size and color exchange within 14 days from the date of delivery of the goods.
8.1.2 The deadline for making an exchange is 14 days from receipt of the goods. To make the exchange you must send an email to info@nicolaconca.com in which you must indicate the order number, the email you used when ordering and the code of the new product you wish to replace. The product must be returned in its original packaging complete with all its parts and must not be worn under the sole.
8.1.3 Shipping for the return of products is the responsibility of the customer, while we are responsible for shipping the new product. As soon as we receive the package, we will ship the new product. It is necessary that the goods have never been used, are fully intact, with delivery document and in their original packaging.
8.1.4 For orders placed and shipped to countries outside the European Union (non-EU), direct exchanges of merchandise are not available. If the customer wishes to exchange a product (for example, to change the size or model), the following procedure must be followed:
- place a new order for the desired item
- request a return for the item you received
9. Right of withdrawal
9.1 The Customer may unilaterally cancel the order within 3 days of order confirmation, without penalty. Such cancellation must be made by written notice sent to info@nicolaconca.com.
9.2 The right of withdrawal is subject to the following conditions: the returned Products must be returned in their entirety; the returned Products must not have been used, washed or damaged; the returned Products must be returned in their original packaging. Shipping for the return of the products including customs charges shall be borne by the customer.
9.3 If the right of withdrawal is exercised by you in accordance with the above conditions, the Seller shall refund the sums paid by the customer, net of shipping costs, no later than 30 days after the Seller's receipt of the returned products.
9.4 If you exercise your right of withdrawal, the Seller will refund the corresponding amount within 30 days from the date the returned Products are received by the Seller in accordance with the procedures indicated above, by crediting the amount to be refunded with the same payment methods you chose when placing your order.
10. Product warranty
On cliziashoes.it are offered for sale exclusively branded products that the seller produces directly with manual processing. They are therefore to be considered limited edition products. The Seller does not sell second-hand products, the manual workmanship and finishes (including ageing/vintage wear/small imperfections) are part of the product that is sold as such and should not be considered as defects. The manual workmanship makes the product unique, therefore it may differ from the product images presented on the website.
11. Washing notes
Accessories : To avoid rusting, which is a consequence of water depositing inside the ACCESSORY, it is advisable after washing to dry the inside of the shoe carefully using a hair dryer. In any case, the risk of rusting is minimal.
12. Applicable law and settlement of disputes
The General Terms and Conditions of Sale are governed by Italian law and in particular by Legislative Decree No. 206 of 6 September 2005 on the Consumer Code, with specific reference to the regulations on distance contracts and by Legislative Decree No. 70 of 9 April 2003 on certain aspects of electronic commerce. In the event of disputes between the Seller and each end user, the place of jurisdiction shall be Trani.
